    How to Calculate and Manage Leave Entitlements for Employees in the UAE

    Handling leave entitlements is an important and crucial aspect of payroll and human resources management for businesses and companies in the UAE. Knowing the laws and regulations governing leave well is critical in order to make sure compliance with UAE labor laws, escaping penalties, and ensuring employee satisfaction and retention. Leave entitlements in the UAE are handled through the UAE Labor Law that streamlines different forms of leaves employees are entitled to, like annual leave, sick leave, maternity leave, and other type of leaves.

    Forms of Leave Availabilities in the UAE

    The UAE Labor Law provides numerous types of leaves which employees are able to avail, where every leave has its own requirements and prerequisites.  

    1. Annual Leave
    2. Sick Leave
    3. Maternity Leave
    4. Paternity Leave
    5. Special Leave (Hajj, Marriage, etc.)

    Annual Leave Entitlements

    Under the UAE Labor Law, all the workers in a company can avail annual leave depending upon the time frame of their employment. Those who have finished at least one year of employment can get 30 days of paid leave for a year. Those who have not completed one year of their job, leave is calculated pro-rata at 2 days for leave in every month since after the completion of the probation period. In order to analyses the annual leave for employees, businesses have to consider the following requests:

    • Pro-Rata Calculation for half of the Year: those workers which have worked for less than a complete year, their annual leave is being analyzed on a pro-rata basis. Like for instance a person has been employed for six months, they are applicable to 15 days of annual leave.
    • Deposit System: Leave is usually deposited monthly. That means the employees get their leave time by time instead of getting all the 30 days leave at once.
    • Unutilized Leave: Any unutilized leave has the chance to be carried forward to the next year, depending upon the employer policies, or can be compensated at the time of employment termination.

    Principle Things to Manage Annual Leave:

    It is the responsibility of Company that they must make sure that leave is provided without disturbing any of the business operations. Payroll services that are provided in Dubai mostly provide a system that automates the leave tracking hence making it sure that the calculation and management of leave is easy and done accurately.

    Sick Leave Entitlements

    Employees in the UAE are also able to get a total of 90 days of sick leave each year, which can be seen as follows as per the rule for salary cuttings: 

    • First 15 Days: Full pay leave
    • Next 30 Days: Half pay leave
    • Subsequent 45 Days: Unpaid leave

    An employee is entitled to get sick leave, once their probation period has been finished. Along with that employees are required to submit their proof of sickness in terms of a medical report in order to avail the sick leave. In order to handle the manage sick leave, the company must be able to do following tasks:

    • Correct Tracking: Company must be able to track the time period of sick leave availed by the employees and they have to make sure that the salary adjustments are made correctly based up on the number of days that have been taken for leave.
    • Payroll Adjustments: Payroll systems should be able to adjust the wage calculations automatically depending on the matter if the employee is entitled to full pay, half pay, or unpaid leave for their sick days.

    Maternity and Paternity Leave Entitlements

    In the UAE, maternity leave for the female employees is as follows:

    • 60 days of leave: of total 60 days, the first 45 days are based upon full paid leave and the other days of leave that is 15 days left are based on half paid leaves.
    • Moreover, female employees are able to avail minimized working hours for the upcoming six months after the employee has been returned from maternity leave.

    Paternity Leave: Male employees, at the time of fatherhood are able to avail up to 5 days of paternity leave, which are available within six months since the baby is born.

    • Payroll outsourcing services in Dubai or UAE usually utilize the tools which can analyses and calculate maternity and paternity leave automatically, hence making sure the compliance and accurate payments.
    • Companies must mitigate the leave issue by keeping the backup of temporary employees, staffing or workload redistribution in the time frame of maternity or paternity leave.

    Leave for Special Occasions

    The UAE Labor Law also provides leave for special occasions which are as follows:

    • Hajj/Pilgrimage Leave: a total of 30 days of unpaid leave for those who will be performing the pilgrimage or hajj only once during their employment time.
    • Marriage Leave: not all but few companies have the additional leave for employees who are getting married, however it is simply based upon the employer’s will.

    Handling the Leave Entitlements through Payroll Services

    Handling the leave entitlements efficiently need the integration of leave policies into payroll systems, that can become a challenge for the large workforce. Payroll service provider in Dubai and UAE handles the burden by automating leave calculations for annual, sick, and maternity leaves. They make sure that company is being compliant with UAE labor laws, provide ways to escape fines and legal issues.
