    What Are Family Law Mediation Services and How Do They Work?

    Family disputes can involve emotionally difficult decisions about divorce, child custody, parenting time, property, and finances. Going to court can make these disagreements more stressful, time-consuming, and expensive, which is why some families consider mediation as an alternative way to resolve their disputes.

    Family law mediation is a process in which a neutral third party helps family members discuss disputed issues and work toward an agreement. The mediator does not represent either side or make decisions for the participants but instead helps them communicate, identify options, and reach mutually acceptable solutions.

    What Are Family Law Mediation Services?

    Family law mediation services provide a structured setting where people can address disagreements outside of a traditional courtroom proceeding. Depending on the circumstances, mediation may address issues such as child custody, parenting schedules, property division, and other family-related disputes.

    In California, courts make mediators available for contested custody and visitation matters. California Family Code § 3160 requires each superior court to make a mediator available, although the specific procedures and services can vary by court.

    How Does Family Law Mediation Work?

    The process generally begins with an intake or orientation session. The mediator explains how mediation works, identifies the issues that need to be addressed, and may review relevant information before the parties begin discussions.

    During mediation, each person has an opportunity to explain their concerns and priorities. The mediator can help clarify disagreements, encourage productive communication, and explore possible solutions without taking sides.

    What Issues Can Be Resolved?

    The issues discussed depend on the type of family dispute and the mediation program involved. In child custody matters, mediation commonly focuses on legal and physical custody, parenting time, and developing a parenting plan that serves the child’s best interests.

    California courts explain that custody mediation focuses on helping parents develop arrangements that support their children’s needs and maintain healthy relationships with both parents. Child support, spousal support, and property division are generally handled separately in California’s court-connected custody mediation process.

    What Happens If Both Parties Reach an Agreement?

    If the parties reach an agreement, the terms can be put into writing for review and, when appropriate, submitted to the court. Once properly approved and entered as a court order, the agreement can become legally enforceable.

    A written agreement can also reduce future confusion by clearly explaining responsibilities, schedules, financial arrangements, or other terms. Parties should understand the consequences of an agreement before signing it.

    What If Mediation Does Not Work?

    Mediation does not guarantee that the parties will reach a settlement. If they cannot agree, the dispute may proceed through the court process, where a judge can make decisions on unresolved issues.

    California’s mediation rules emphasize voluntary participation and self-determination, meaning a mediator cannot force someone to settle. California Rules of Court, Rule 3.853, also recognizes that participants may withdraw from mediation.

    Can Attorneys Participate in Mediation?

    An attorney can provide valuable legal guidance before or during mediation. While the mediator remains neutral, each party’s attorney can explain legal rights, review proposed terms, and help determine whether an agreement is in the client’s interests.

    Legal advice can be particularly important when the dispute involves significant assets, complicated custody concerns, business interests, or other issues with long-term consequences.

    When Should You Consider Mediation?

    Mediation may be useful when both parties are willing to communicate and negotiate in good faith. It can provide more control over the outcome and may help families resolve disputes without requiring a judge to decide every issue.

    However, mediation may require additional safeguards or may not be appropriate in every situation, particularly when there are serious safety concerns or significant power imbalances. Discussing the circumstances with a qualified family law professional can help determine whether mediation is appropriate.
