    What Is an Australian Partner Visa?

    An Australian Partner Visa allows the spouse or de facto partner of an eligible sponsor to live in Australia. In many cases, the process happens in two stages: first, a temporary Partner Visa is considered, and later, the permanent Partner Visa stage is assessed.

    The purpose of the visa is to help genuine couples live together in Australia. It may apply to married couples, de facto couples, and, in some cases, couples who first apply through the Prospective Marriage Visa pathway.

    Although the idea sounds simple, Partner Visa applications are evidence-heavy. The Department does not only look at one document or one photo. Instead, it considers the overall history and nature of the relationship.

    Main Types of Partner Visas in Australia

    There are different Partner Visa pathways depending on where the applicant is located and the couple’s circumstances.

    Partner Visa Subclass 820 and 801

    The Subclass 820 and Subclass 801 Partner Visas are commonly known as the onshore Partner Visa pathway.

    The Subclass 820 is the temporary visa stage. It allows the applicant to stay in Australia while the permanent stage is being processed. The Subclass 801 is the permanent Partner Visa stage.

    This pathway is generally used when the applicant is in Australia at the time of application. Couples usually apply for both the temporary and permanent stages together, but the permanent stage is usually assessed later.

    Partner Visa Subclass 309 and 100

    The Subclass 309 and Subclass 100 Partner Visas are commonly known as the offshore Partner Visa pathway.

    The Subclass 309 is the temporary visa stage, while the Subclass 100 is the permanent visa stage. This pathway is generally used when the applicant is outside Australia at the time of application.

    This option may suit couples who are living in different countries or planning for one partner to move to Australia in the future.

    Prospective Marriage Visa Subclass 300

    The Prospective Marriage Visa, also known as the fiancé visa, is for people who intend to come to Australia to marry their prospective spouse. After marriage, the applicant may then apply for a Partner Visa.

    This visa is often relevant for engaged couples who are not yet married and may not meet the de facto relationship requirements.

    Who Can Sponsor a Partner Visa Applicant?

    The sponsor is usually the Australian partner. To sponsor a Partner Visa applicant, the sponsor must generally be one of the following:

    An Australian citizen
    An Australian permanent resident
    An eligible New Zealand citizen

    The sponsor must also meet sponsorship requirements. These may include character-related checks and other eligibility considerations. Therefore, it is important for both partners to understand that the application is not only about the applicant. The sponsor’s background and circumstances can also be relevant.

    What Does “Genuine Relationship” Mean?

    A genuine relationship usually means the couple has a real commitment to each other and shares a life together, either physically, emotionally, financially, or socially. Others may have spent time apart because of work, study, visa limitations, family responsibilities, or travel restrictions. What matters is whether the couple can explain their circumstances clearly and provide consistent evidence.

    Common Evidence for a Partner Visa Application

    Partner Visa evidence should show the full picture of the relationship. A strong application usually includes documents from different areas of the couple’s life.

    1. Financial Evidence

    Financial evidence can show how the couple shares financial responsibilities. This may include joint bank account statements, shared bills, rental payments, money transfers, joint purchases, insurance policies, or evidence of financial support.

    However, not every couple has a joint bank account. In that case, other financial records may still help show how the couple supports each other.

    4. Commitment Evidence

    Commitment evidence shows the couple’s long-term intention to stay together. This may include future plans, marriage plans, children, wills, superannuation nominations, long-term communication records, travel together, or personal statements explaining the relationship.

    This is often one of the most important parts of the application because it helps connect the documents to the real story of the couple.

    Inconsistent Dates or Information

    Inconsistencies can create concerns. For example, if one partner says the relationship started in January and the other says March, this should be clarified. Small errors can happen, but unexplained contradictions may weaken the application.

    Ignoring Periods of Separation

    Many couples spend time apart. This is not automatically a problem. However, the couple should explain why they were separated and provide evidence of continued communication during that period.

    Waiting Until the Last Minute

    Partner Visa applications require time. Gathering police checks, identity documents, relationship evidence, statements, and sponsor documents can take longer than expected. Starting early can reduce stress and improve the quality of the application.

    Partner Visa processing times can vary. The Department considers many factors, including whether the application is complete, whether further information is needed, the complexity of the case, and the volume of applications being processed.

    Because processing times can change, couples should check the latest official processing time information before applying. It is also wise to prepare the application carefully from the beginning, as missing documents can cause delays.

    Can You Work While Waiting for a Partner Visa?

    For many onshore applicants, visa conditions can affect whether they can work while waiting for a decision. Some applicants may move onto a bridging visa after their current visa expires, but the exact conditions depend on the person’s situation and visa history.

    Because this area can be complex, applicants should check their visa conditions carefully before working, studying, or travelling.

    What Happens After the Temporary Partner Visa Is Granted?

    If the temporary Partner Visa is granted, the applicant can usually remain with their partner while waiting for the permanent stage. Later, the Department may assess whether the relationship is still genuine and continuing.

    At the permanent stage, couples may need to provide updated evidence showing that the relationship has continued since the first application. This may include updated financial documents, household evidence, photos, travel records, and statements.

    In some situations, the permanent stage may still be possible even if the relationship has ended, such as where family violence or other specific circumstances apply. These cases can be sensitive and should be handled carefully.
