If you find your car has been taken away by the towing company without informing you or when you didn’t expect it, it can be alarming. Even if you parked your vehicle on a familiar road or street, you thought it was safe. Suddenly, some questions will arise within yourself: Who moved it? Why? In many cities, drivers are facing these illegal or improper towing practices, and they are often unaware of them.

These are surely falling into the category of unlawful towing. Many people are still facing unlawful towing, and some of the common examples of unlawful towing include missing signage, improper consent, or towing without notifying the proper authorities. So, what to do? How to face these kinds of illegal activities? What are the crucial steps to take?

Understanding the essential steps to take can make all the difference in getting your vehicle back without paying more than necessary.

Understanding the Meaning of “Unlawfully Towed”

“Unlawfully towed” means that the car has been moved or impounded in violation of legal regulatory standards. It involves:

    • If your car is parked legally in a parking space, there is no proper reason for moving.
    • The towing company or property owner failed to follow required procedures (such as posting signs or notifying authorities).
    • You weren’t given proper notice or the chance to redeem your vehicle under applicable law.

Whether the removal of a car by a towing company that didn’t comply with local or state towing laws or violated your rights, you are just facing an unlawful tow. So, you must take legal steps to avoid getting tangled in such practices.

    Steps to Take Right Away
Let us understand some clear steps of what to do if you believe your car has been unlawfully towed:

    1. Double-check and ensure that your car is really missing. That means make sure your car is present or not; maybe you or your family members will park somewhere else. Ask nearby shop owners or neighbors, or any building staff, if they saw a tow truck take the car. In rare cases, cars are moved for road maintenance or safety reasons.
    2. If your car has been towed, then check where they have taken it. Call your local police or nearby authorities and report your situation to them. Write down the name, contact number, and address of the towing company that took your car. It really helps you a lot while getting your car back or filing a complaint.
    3. Then, gather essential documents such as a driver’s license or photo ID, car registration, and proof of insurance when you go to the impound yard. Double-check your car when you get your vehicle back, and take clear photos of every side to check for any new damage or missing items.
    4. Speak politely with the towing company about why the car has been towed. Request the exact reason your car was moved or impounded. Check for any warning signs or any disclaimer present in the location where you parked the vehicle. If there is no presence of warning signs, the towing company violated the local law. And you can sue the towing company.
    5. If you believe your car is involved in unlawful towing, you can take legal steps. Many cities or counties let drivers request a fast hearing or file a formal complaint against the towing company. Don’t wait to file a case for too long because some cities only provide a few days to act. Keep official documentation of all forms and emails for your records.
    6. If you should pay to release the car, ensure that the fees match local towing laws. Ask for a detailed receipt after the fees are paid. Save all documentation related to the towing process, payment proof, and towing slips. If your complaint is approved later, you may be able to get that money back.

    Key Takeaways

    • Know your legitimate rights; it definitely helps at any cost. Unlawful towing happens when the correct procedures are not followed, such as when warning signs are missing or when the vehicle owner did not give permission.
    • Act fast to get results fast. Finding your car quickly, collecting all necessary documents, and asking for an explanation right away gives you the best chance to avoid paying extra fees.
    • Keep all documents and records safe for future assistance. Save all your receipts, photos, and any written messages because they can help you if you choose to contest the tow.
    • Stay proactive. Always check parking signs before leaving your vehicle, and respond quickly if your car is towed to save both time and money.
