For most people, a smartphone is a camera, GPS, wallet, calendar, messaging device, entertainment center, and connection to the rest of the world.
For investigators, it can be something else entirely: evidence.
Modern criminal investigations increasingly involve information generated by phones, apps, social media platforms, vehicles, security cameras, cloud accounts, and other connected devices. A case that once depended primarily on eyewitness testimony and physical evidence may now involve thousands of text messages, location records, photographs, videos, search histories, and other pieces of digital information.
That has fundamentally changed both criminal investigations and criminal defense.
Your Phone Knows More Than You Think
Consider how much information an ordinary smartphone can potentially contain.
There may be text messages, emails, photographs, videos, call histories, contacts, browser activity, app data, location information, calendar entries, notes, and records of communications through social media platforms.
And the phone itself is only part of the equation.
Information associated with a user may also exist on remote servers operated by technology companies. Other devices can create additional records. Smartwatches may collect activity data. Vehicles may maintain location or operational information. Doorbell cameras can capture video. Businesses and homes increasingly use high-definition surveillance systems.
As a result, an investigation can sometimes reconstruct a person’s movements and communications in extraordinary detail.
Digital Evidence Is Not Limited to “Cybercrime”
It would be easy to assume digital forensics primarily matters in hacking, fraud, or other computer-related offenses.
That is no longer the case.
Digital evidence can potentially appear in almost any type of criminal investigation.
In a DUI investigation, for example, timestamps, photographs, videos, electronic receipts, or location information might become relevant to establishing a timeline.
In a domestic violence or stalking case, text messages, call histories, social media communications, or location information may become important.
In a theft or fraud investigation, electronic payments, online accounts, emails, or marketplace communications could play a role.
In more serious felony investigations, law enforcement may examine enormous quantities of digital information while attempting to establish relationships, communications, locations, or intent.
The line separating our “digital lives” from our “real lives” has largely disappeared.
A Screenshot Doesn’t Always Tell the Whole Story
One of the most important issues with digital evidence is context.
Imagine seeing a screenshot of a single text message:
“I’ll take care of it tonight.”
Standing alone, that statement could sound suspicious. But what if the messages immediately before it reveal that the people were discussing fixing a computer?
Context can completely change meaning.
The same issue arises with social media posts, direct messages, photographs, search histories, and other electronic evidence. Investigators may focus on a particular communication because it appears relevant to their theory of a case, while surrounding information paints a different picture.
This is one reason criminal defense attorneys increasingly have to think like digital investigators themselves.
Reviewing what the government found may not be enough. The defense may also need to determine what the government overlooked.
Metadata Can Matter as Much as the Message
Digital files frequently contain information beyond what users see on the screen.
Metadata can potentially provide information about when a file was created or modified, what device produced it, and other technical details surrounding the file.
That information can become significant when the authenticity or timing of digital evidence is disputed.
A photograph may show something important, for example, but additional questions remain.
When was it taken?
Where did it come from?
Was it edited?
Was it downloaded from somewhere else?
Does the timestamp accurately reflect when the depicted event occurred?
Digital evidence can look definitive while still requiring careful examination.
Location Data Has Changed Investigations
Smartphones have also created unprecedented questions about location privacy.
Depending on the circumstances and the information legally obtained, digital records can potentially help investigators determine where a device was located during a particular period.
That capability is powerful enough that the United States Supreme Court has recognized significant privacy interests in certain historical cell-site location records.
Location evidence can be incriminating, but it can also be exculpatory.
Suppose investigators believe someone was at a particular location when a crime occurred. Reliable digital information placing that person’s device somewhere else could become extremely important to the defense.
Technology cuts both ways.
Deleted Doesn’t Necessarily Mean Gone
Many people assume deleting something from a phone makes it disappear forever.
Digital information is rarely that simple.
A communication might remain on another person’s device. Information could have been synchronized with a cloud service. A platform may retain records independently. Screenshots, backups, or other copies may exist.
That does not mean every deleted item is always recoverable. It means users should not assume pressing “delete” guarantees that information has ceased to exist.
More importantly, once someone knows they are under investigation or involved in a criminal case, intentionally destroying potentially relevant evidence can create additional legal problems.
Trying to “clean up” a digital footprint after learning about an investigation may make an already difficult situation considerably worse.
Can Police Search a Smartphone After an Arrest?
An arrest does not automatically give law enforcement unlimited authority to browse through everything stored on someone’s smartphone.
The United States Supreme Court has recognized that modern phones are fundamentally different from ordinary physical objects because of the enormous quantity and variety of personal information they can contain.
As a general rule, law enforcement needs a warrant to search the digital contents of a cellphone seized during an arrest, although exceptions to warrant requirements can apply depending on the circumstances.
The details matter.
Questions involving consent, warrants, the scope of a search, emergency circumstances, and information obtained from third-party service providers can become central issues in a criminal case.
Florida law also specifically regulates government access to certain stored electronic communications and customer records.
Search Warrants Are Becoming Digital Road Maps
Traditional search warrants might bring to mind officers searching a house, vehicle, or other physical location.
Modern investigations often include warrants directed at digital information.
Investigators may seek authorization to examine devices or obtain information associated with electronic accounts. Depending on the case, that can produce enormous quantities of data.
But the existence of a warrant does not necessarily end the legal analysis.
Defense attorneys may examine how the warrant was obtained, what information established probable cause, what property or information the warrant authorized investigators to search, and whether the search remained within its lawful scope.
Digital investigations may involve massive datasets, but constitutional protections still apply.
Social Media Can Become Evidence
Posting online can also create unexpected consequences.
Photos, videos, comments, direct messages, public posts, and interactions with other users can potentially become relevant to an investigation.
Sometimes the connection is obvious. A person might post a video depicting the conduct being investigated.
Other situations are much more ambiguous.
A joke could be interpreted literally. Lyrics or memes could be presented without context. An old photograph could be mistaken for a recent one. A social media interaction might be characterized as evidence of a relationship that was far more complicated in reality.
This is another area where context becomes critical.
People facing criminal allegations should also be cautious about discussing an active case online. Attempting to publicly explain what happened can unintentionally generate additional statements for investigators or prosecutors to examine.
AI Will Make Digital Evidence Even More Complicated
Artificial intelligence adds another layer to the problem.
For decades, photographs, recordings, and videos carried an intuitive sense of authenticity. If you saw someone doing something on video, the natural assumption was that it actually happened.
Deepfakes and generative AI are weakening that assumption.
Artificially generated voices, images, videos, and written communications are becoming increasingly sophisticated. As these technologies improve, courts and attorneys may face more disputes about whether digital evidence is authentic.
At the same time, AI tools are increasingly capable of processing enormous datasets.
Imagine an investigation containing hundreds of thousands of messages, documents, images, and other records. Software can help identify patterns and locate potentially relevant material much faster than a human could manually review everything.
But speed does not eliminate the need for human judgment.
Algorithms can identify information. Lawyers, investigators, judges, and juries still have to determine what that information actually means.
The Digital Trail Can Help the Defense Too
The public often thinks of digital evidence as a tool for prosecutors.
That is only half the story.
Electronic information can sometimes provide powerful evidence for the defense.
Messages may contradict an accusation. Location records may challenge a timeline. Surveillance footage may show what actually occurred. Electronic transactions can establish where someone was at a particular time. Photographs can preserve evidence that no longer exists physically.
A strong defense therefore may involve more than challenging the prosecution’s digital evidence.
It may involve finding digital evidence the prosecution never collected.
Preserving that information early can be particularly important because digital evidence can disappear. Surveillance systems overwrite recordings. Accounts get deleted. Devices are replaced. Messages vanish. Companies have different retention practices.
Time matters.
Criminal Defense Is Becoming Increasingly Technical
The courtroom itself may look familiar, but the evidence entering it has changed dramatically.
Criminal defense attorneys increasingly encounter smartphones, surveillance footage, social media records, cloud accounts, GPS information, electronic communications, and other forms of digital evidence.

We have built a world in which our devices constantly generate information.
Most of the time, that data exists quietly in the background. But when a criminal investigation begins, information that once seemed insignificant can suddenly become evidence.
A text can establish a timeline. A photograph can identify a location. A smartwatch can record activity. A security camera can contradict a witness. A social media message can be interpreted as evidence of intent.
At the same time, digital evidence is not automatically accurate, complete, or properly interpreted simply because it came from a computer.
The next generation of criminal cases will increasingly require courts to answer a difficult combination of technological and constitutional questions: What information exists? How was it obtained? Is it authentic? What does it actually prove? And how much privacy should people retain in a world where almost everything leaves a digital trail?
Technology may be creating more evidence than ever before.
Understanding what that evidence actually means is becoming the harder problem.
