How Rear-End Crashes Can Affect You and What You Should Do Next

Around 1.7 million rear-end crashes take place in the United States every year. Even though these accidents may seem minor at first, they can lead to serious injuries, emotional stress, and financial challenges for victims.

The common causes of rear-end crashes include tailgating, distracted driving, brake failures, and poor weather conditions. Knowing how rear-end crashes can affect you will help you understand the actions you should take immediately after such an accident to protect your legal rights and financial future.

Physical and Emotional Effects of Rear-End Crashes

Physically, rear-end crashes cause injuries like:

    • Whiplash from sudden movement of the neck
    • Concussions
    • Spinal cord injuries
    • Traumatic brain injuries
    • Broken bones

Some of these injuries may not be obvious after a crash, and symptoms can occur days later. That is why getting medical attention immediately after a crash is essential.

Victims also suffer emotionally after a rear-end crash. People often experience anxiety, shock, and a fear of driving. In some severe cases, it could lead to post-traumatic stress disorder (PTSD), which can disrupt a person’s daily life. Ensure you address both your physical and emotional needs in your recovery after an accident.

    Legal Consequences of Rear-End Crashes

In most rear-end crashes, traffic laws that require drivers to maintain a safe distance place the fault on the driver who hits the car from behind. Traffic laws that require drivers to maintain a safe distance make this assumption. However, this is not always the case. Sometimes, the lead vehicle could suddenly stop and have malfunctioning brakes or lights.

To protect your legal rights, thoroughly document the scene. Take photos of the damage done to the cars, road conditions, and any injuries. If there are witnesses, collect their contact details and ensure they file a proper police report. This documentation will be essential when following up on compensation through legal channels.

What You Should Do After a Rear-End Crash

    • Ensure Safety and Medical attention: First, remain at the scene but ensure you are safe and those around you are in safe zones. If anyone is injured, call for medical assistance. Even if your injuries are not apparent, ensure you visit the emergency room afterward.
    • Exchange Information: Exchange essential information with the other driver, including their names, phone numbers, license plates, and insurance information. During this exchange, don’t admit fault. Be polite, but avoid making statements like ‘I’m sorry’ that others can use against you later.
    • Take Photos and Videos: As mentioned, document the scene by capturing photos or videos of the accident scene, traffic signs, and road conditions. Write the series of events as you remember while everything is fresh.
    • Contact a Lawyer: Consult a lawyer as soon as possible to discuss your legal rights and file a claim.

How to Deal with Insurance and Legal Claims

Navigating the insurance and legal processes can be very overwhelming after an accident. When notifying your insurance company, provide all the important details, including photos and medical reports. Be honest in your account, but avoid speculating who is at fault, as this can affect your claim.

Insurance companies always try to reduce payouts, so it is essential to understand the scope of your insurance coverage. If the other driver is at fault, their liability insurance will cover the damages and medical expenses. However, sometimes there might be disputes, and the settlement won’t cover the losses and damages.

Working with a car accident attorney can be very helpful in such cases. They can negotiate with the insurance companies, gather evidence, and represent you in court when necessary. They will also ensure you get compensation for non-economic losses like pain and suffering.

    Conclusion

Unlike what most people think, rear-end crashes can have lasting effects. Even though, after an accident, everything is overwhelming, it is important to take the correct steps to protect your rights. Remember to be proactive and don’t hesitate to consult an attorney for legal advice.
