What to Do Right After a Car Accident: Know Your Rights

Victims of a car accident have the right to compensation from the liable party, but they may not know how to get this money. While it may seem easy enough to just file a claim and let the insurance company handle the situation, it doesn’t always work out well. Instead, victims of car accidents will want to take the following steps to protect their rights.

    Seek Medical Attention Right Away

It is crucial for anyone who is injured to seek medical attention right away. If they do not need to go to the emergency room via an ambulance, they should still go to the doctor within a couple of days of the accident to make sure they are okay and to get a medical record of any injuries. It is possible the person could suffer from hidden injuries, so this will help them with their recovery. It will also be important when contacting a lawyer, as it creates medical records that can be used to request compensation.

Take as Many Photos as Possible

It is a good idea to take as many photos as possible, as these may be needed as evidence. At the scene of the accident, take photos of the vehicles, the road conditions, the weather, and more. Afterward, it is a good idea to take better photos of the collision damage to show how the vehicle was damaged and what needs to be repaired. This can also help with obtaining compensation to ensure the funds received are enough to cover the vehicle’s repairs.

Get an Estimate for Vehicle Repairs

It is a good idea to get information about how much it will cost to repair the vehicle. Keep in mind that there may be hidden damages that are detected as work begins on the vehicle. It will be important to get the vehicle repaired quickly to know the full cost of the repairs and to ensure the settlement is going to cover everything, not just what can be seen on the exterior of the vehicle. If it is too expensive to repair the vehicle, it may be considered totaled, and the driver will need to seek funds to replace it instead of covering repairs.

File a Claim with the Insurance Company

It will be a good idea for the driver to file a claim with their insurance company. They will want to include as much detail about the accident as possible to show who was at fault for it. The insurance company should then work with the liable party’s insurance company to obtain compensation. It is a good idea to have a lawyer to help with this part of the process, as the insurance company may not be willing to pay out as much money as the victim needs. The lawyer can help to ensure the settlement is fair and provide the victim with other options if needed before they accept a low settlement offer.

If you’ve been injured in a car accident, it is a good idea to speak with a lawyer as soon as possible about the case, even if you’ve filed a claim with the insurance company. They can help ensure the compensation received is sufficient to cover all damages and, if it’s not, help with obtaining a higher settlement.
