    The gaming and technology industries are among the top sectors experiencing some of the highest growth rates worldwide. These sectors are always in search of skilled and experienced professionals — and that sometimes means bringing aboard hired guns from overseas.

    Many international professionals are eager to find opportunities to immigrate and work in the United States. There are several immigration processes and requirements that an individual has to go through before immigrating to the country for employment.

    Keep reading to see five types of US work visas that allow professionals in the gaming and technology spaces to immigrate and work in the US.

    1. H-1B Visa for Specialty Occupations

    The H-1B visa is the most popular employment-based visa for the US. This type of visa is for immigrants who are employed in “specialty occupations,” meaning they require specialized knowledge and possess at least a bachelor’s degree or equivalent experience.

    Many jobs in the gaming and technology industries fall under this category. For instance, the software engineers, game programmers, data analysts, and system architects fall under this category. Under this type of visa, the US employer sponsors the immigrant and files a petition for the immigrant. The H-1B visa allows immigrants to stay and work in the US for a certain amount of time. After this period, the immigrant may extend the visa.

    Anyone thinking about applying for one should consider calling an immigration lawyer to help. The application process isn’t as simple as it might appear, so expert guidance is vital.

    2. O-1 Visa for Individuals with Extraordinary Ability

    The O-1 visa is for people who have demonstrated an extraordinary ability in their field. This visa is normally reserved for artists, athletes, and scientists. However, it may also be awarded to technology and gaming professionals who have achieved an exceptional level of success.

    For instance, a game developer who has received prestigious awards in the field or has worked on widely recognized games may be eligible for this visa.

    Unlike some of the other visas, the O-1 visa doesn’t have an annual quota. However, the applicant must demonstrate exceptional ability in the field and may face a rigorous qualification process.

    ​3. L-1 Visa for Intracompany Transfers

    The L-1 visa is for employees who are working for an international corporation that has an office in both the home country and the US. It’s for corporations that wish to transfer certain employees from a foreign office to a US office.

    Many technology corporations have offices in several countries globally. Many game developers have teams in several countries.

    There are two types of L-1 visas. The L-1A visa is for managers and executives. The L-1B visa is for employees with specialized knowledge of the company’s products, services, and technology.

    4. TN Visa for Canadian and Mexican Professionals

    Professionals from Canada and Mexico may qualify for the TN visa. The US, Mexico, and Canada signed the United States-Mexico-Canada Agreement (USMCA), also known as the NAFTA agreement. The USMCA allows professionals from Canada and Mexico to enter the US and perform specific jobs.

    The TN visa has an easier application process compared to other employment visas. Canadian professionals may apply for the visa at the port of entry. Mexican professionals must apply for the visa at the US consulate.

    5. E-2 Visa for Entrepreneurs and Investors

    Professionals in the gaming and tech spaces may also choose to become entrepreneurs and start their own businesses. The E-2 visa is for entrepreneurs and investors. It’s for people from treaty countries who invest a significant amount of money in a business.

    Under this visa type, someone can start or run a business in the US as long as they can demonstrate that the investment is substantial and that the business will be successful.

    Choosing the Right Path

    A gaming or technology professional will want to consider various factors — like educational achievements and whether they have a sponsor — before selecting a visa.

    While some professionals may choose employment visas through existing companies, others may pursue entrepreneurial opportunities or intra-company transfers. However, immigration requirements are often complex and subject to change. Thus, it’s advisable to research visa options and seek professional advice where possible.
