We’re living in a world where everything can be advertised, including cannabis products. With 24 states in the US having legalized the use of cannabis products, there is a need for proper advertising regulations. Cannabis advertising in the US remains heavily restricted under federal prohibition and state-by-state rules. This has given brands a bigger challenge in advertising cannabidiols. Of course, no brand wants to get penalized for breaking the rules. If you’re a brand looking for the right way to advertise cannabis products, you should completely read our state-by-state guide to cannabis advertising laws in 2025!

Marketing Laws: The Challenge Faced by Many Brands

In brief, the main goal of cannabis advertising rules isn’t to prevent brands from attracting customers. After all, the US cannabis market is expected to reach $76.39 billion by 2030. The figures have exceeded previous forecasts and show a predicted annual growth rate (CAGR) of 12.1% from 2024 to 2030. Well, this industry growth presents a significant opportunity in the states where weed is legal.

Hence, it is challenging for cannabis brands to capitalize on that opportunity by maximizing their advertising channels while maintaining compliance. However, it doesn’t mean that those cannabis brands should stop their businesses. The thing they can do to advertise the right way is to present their products properly. For example, cannabis brands can use exotic weed packaging bags. These bags are customizable and printable, perfect for advertising their brands.

The THC (Compounds) Advertising Laws by State

Cannabis advertising laws are varied, as each state has its perspectives and opinions about cannabis products.

How brands should advertise their products and cannabis marketing restrictions differ for each state. Here, we will discuss the laws and regulations for advertising cannabis products in some states.

    New York

The Cannabis Control Board in New York recently approved new cannabis advertising and marketing rules. The purpose is to provide legal marijuana operators an advantage over illegal operators.

Here are the principal regulations brands should note:

    • The ads should not feature price discounts or loyalty rewards.
    • Brands can use bright colors and enhanced lettering on their cannabis ads.
    • Digital ads on websites are allowed, whereas the websites should have visitors who are over the age of 21
    • Dispensaries can advertise their contact information on billboards
    • Outdoor signage to an unlimited number is allowed in retail shops and
    • Only three outdoor signages are permitted in other stores

    Dallas, Texas

Up ‘till today, weed products are still illegal in Texas. However, it’s quite a complicated story. So, the right has vowed to outlaw all forms of THC in Texas next year. However, a Democratic rep out of Dallas wants to legalize marijuana for recreational use.

The fact is the ban on THC in Texas might have deadly consequences for patients seeking pain relief or other benefits of marijuana compounds. For example, Delta-8 is effective at helping to ease chronic pain symptoms. In fact, this cannabis product also helps reduce stress, low appetite, nausea, and vomiting (mainly due to chemotherapy treatments). Plus, Delta-8 has great potential for helping mental health conditions such as depression and bipolar disorder.

    Florida

    Is weed legal in Florida?

No, recreational marijuana possession and use remain illegal in Florida. However, a small or limited possession of marijuana is no longer a crime in various Florida communities. Instead, the offenders will only receive a payable citation.

Moreover, the state has also specified strict penalties for the sale or delivery of cannabis products. No brand can sell cannabis products at schools, parks, or colleges.

    Advertising Tips for Brands

Despite the complex cannabis advertising laws, brands should not get discouraged. Instead, there are some ways for cannabis brands to advertise their products without breaking the rules.

Always Be Informed about Local Cannabis Marketing Regulations

Brands should always be informed about the local cannabis marketing regulations. Thus, they should spend time researching and developing a thorough understanding of the cannabis marketing-related laws in their target markets.

    Take Advantage of Programmatic Advertising

Many brands today prefer to run ads in publications centered around cannabis. For example, the High Times and Cannabis Culture allow brands to make contextual placements to reach interested consumers.

Sell Your Brand Instead of Your Products

Instead of blindly selling their products, cannabis brands should focus on what sets them apart and makes them unique. The easiest and best way to do this is to present their cannabis products with packaging that reflects the brand’s identity.

    Wrapping Up

Indeed, the cannabis state-by-state regulations are varied, as each state has its perspectives and opinions. However, there are some ways for cannabis brands to advertise their products without breaking the rules. First, brands should always be informed about the local cannabis marketing regulations. Secondly, they can take advantage of programmatic advertising. Ultimately, instead of blindly selling their products, cannabis brands should focus on what sets them apart and makes them unique.

Well, hopefully, our state-by-state guide to cannabis advertising laws in 2025 will give you more knowledge for your cannabis business.

    Have a nice day!
